A federal judge is set to review Sam Bankman-Fried's defense argument against newly disclosed evidence presented by the U.S. Department of Justice (DoJ) on August 25. Bankman-Fried's legal team claims that an additional 4 million pages of discovery were released less than six weeks before his trial, which is scheduled for October 3. Judge Lewis Kaplan, on August 26, issued an order requesting the government to address the letters from Bankman-Fried's attorneys regarding his access to discovery materials and the prohibition of using evidence produced after July 1. Bankman-Fried's lawyers objected to the recent production of 4 million additional pages of discovery, stating that the government should not be allowed to overwhelm the defense with such a substantial amount of evidence so close to trial. Bankman-Fried's legal counsel will present their arguments during a videoconference hearing on August 30, pursuant to today's ruling by Judge Lewis Kaplan. Bankman-Fried is facing accusations of misappropriating user funds for personal expenses, investments, and political campaign donations. He is confronted with a total of 12 criminal charges, to be heard in two separate trials commencing in October 2023 and March 2024. Recently, Bankman-Fried pleaded not guilty to fraud and money laundering charges brought against him in an updated indictment by prosecutors. During the hearing, his lawyers advocated for improved conditions in the Brooklyn Metropolitan Detention Center, where Bankman-Fried has been detained since his bail was revoked on August 11. They expressed concerns over his dietary restrictions as a vegan, claiming that he has been forced to rely on a limited diet of bread, peanut butter, and water due to the prison's lack of vegan options. Additionally, Bankman-Fried's legal team raised apprehensions about his medical needs, highlighting that he has not received his required medication since being incarcerated.
