In two separate documents presented to the Southern District of New York's United States District Court on October 2, SBF's attorney team has opposed pre-trial requests by prosecution for FTX clients and investors to provide first-hand accounts on their expectations of the crypto exchange's asset management. Furthermore, they have moved to disallow a previous FTX user, a nameless Ukrainian, from testifying via simultaneous video feed, citing the Sixth Amendment. The filings suggested that rulings on evidential credibility of personal testimonies and the understanding of individual relations with FTX or Mr. Bankman-Fried could not be resolved in a hypothetical sense. SBF's legal representatives have accused prosecutors of attempting to execute plans in their favor by barring similar defensive witnesses who would testify on their understanding of FTX's funds management. Calling the action "premature", the defense insisted that determining this issue falls within the remit of the jury's responsibilities. The legal representatives of SBF argued that the testimony from the Ukrainian witness referred to personal hardship due to Russia's military intervention in Ukraine, which could illicit undue sympathy and anger from the jury. The ongoing assault since February 2022 has made international movement challenging, and allowing the testimony could hover on prejudice. "[A]dding a Ukrainian national to the witness stand, and only him, may arouse unwarranted sympathy and lead to conjecture on the witness's reasons for not physically appearing in court", they explained. Just hours prior to the preliminary juror pick for Bankman-Fried's criminal trial, the motions were submitted. At press time, potential juror assessment for conflicts of interest was being undertaken by Judge Lewis Kaplan in preparation for the trial set to conclude in November. With his bail order rescinded by Kaplan in August, and multiple unsuccessful attempts for temporary freedom, Bankman-Fried has spent most of his time imprisoned. Two distinct criminal trials are scheduled for October 2023 and March 2024, in which he denies all 12 fraudulent charges related to FTX and Alameda Research.
