The latest suit was filed on Sep. 5 in San Francisco by a law firm representing two unnamed engineers. The lawsuit claims that the defendants unlawfully gathered personal information from millions of internet users, including minors, without their consent or knowledge. The plaintiffs argue that OpenAI's products, including ChatGPT and DALL-E, wouldn't be the successful business they are today without the alleged theft of private data. The filing requests damages for the plaintiffs and potential members of the proposed classes, as well as a court order for the defendants to disgorge profits obtained through the illegal scraping of data. This lawsuit follows a previous one with similar claims filed against OpenAI and Microsoft in June. It remains uncertain whether the suits will be combined. Microsoft has previously been involved in a legal dispute over scraping when it issued a cease and desist order to data analytics firm HiQ in 2019. HiQ was accused of violating LinkedIn's terms of service agreement by scraping user data, resulting in a legal battle that ended in a settlement. Neither Microsoft nor OpenAI have yet responded to requests for comment.
