Ukraine's Digital Transformation Ministry Unveils Regulatory Roadmap for AI Adoption

On October 7, the Ukrainian Department of Digital Transformation made public its strategic plan for the regulation of Artificial Intelligence (AI). This plan, published on the Department’s website, is specifically designed to assist local businesses in making the transition for a law similar to the AI Act of the European Union. Its goal is also to instruct citizens on safeguarding themselves against potential risks associated with AI. The Department’s official statement on the matter reveals the plan’s reliance on a ground-up strategy of progressively stepping from lesser to more comprehensive measures. The purpose is to equip businesses with the necessary tools for future requirements before the enforcement of any relevant laws. It was further announced in the plan that this initial adjustment phase for companies to potentially new laws will span over the next two to three years. As outlined by Deputy Minister of Digital Transformation, Oleksandr Borniakov: “Our strategy includes nurturing a culture of self-regulation within businesses. This will involve the signing of voluntary codes of conduct reflecting the companies' commitment to the ethical use of AI. A further component is a White Document that will introduce businesses to the approach, timing, and stages of regulatory execution.” As per the plan, the first draft of Ukraine’s AI legislation should be ready in 2024, and not before the EU's AI Act enters into force. This ensures that the national law takes the Act into account.  The EU AI Act, approved by the European Parliament in June, prohibits certain AI products and services, while setting restrictions on others. Technologies outrightly banned include biometric surveillance, predictive policing, social scoring systems, uncategorized facial recognition systems, and so-called “emotion recognition”. AI models that are generative, such as Google’s Bard and OpenAI’s ChatGPT, will be permitted to operate under the condition that their results are clearly flagged as generated by AI.
