The report maintains that if an NFT hosts or connects to an illegitimate replica of a copyrighted work, copyright law will be implicated in the same way as with any unwarranted reproduction or exhibition. It affirms that existing enforcement mechanisms can tackle NFT-related violations just like other online infringements.
Pointing out that NFTs present unique chances for creators to take advantage of their IP rights but also pose new security risks, USPTO Director Kathi Vidal emphasized the confusion among consumers about IP rights and the legal standing of smart contracts. It was ultimately decided that these issues would be managed more effectively through education and consumer protection than changes in IP law.
There were no particular suggestions for employing NFTs or blockchain technology in U.S. patent and trademark registrations, but the prospects of these will continue to be investigated.
The study and report came about following a 2022 appeal from an IP subcommittee of the U.S. Senate Judiciary Committee.
