The Personal Data Protection Agency of Poland has initiated an investigation into OpenAI's ChatGPT on a complaint lodged by an anonymous individual. This person alleges that the company is handling data in a manner that is both illegal and untrustworthy. Jan Nowak, the head of the data protection agency, clarified on September 20 that questions had previously been raised concerning ChatGPT's adherence to European data protection and privacy regulations. As per the accuser, OpenAI is collecting and manipulating information without clear transparency rules. The complainant further highlighted an incident where ChatGPT falsely represented him, and OpenAI failed to fulfill his requests for rights under the European General Data Protection Regulation (GDPR). Nowak admitted that any legal action against OpenAI could prove challenging due to the company's operations outside the European Union. Noting the multiple instances of alleged personal data protection violation, Nowak said OpenAI would be asked series questions to facilitate comprehensive administrative proceedings. Meanwhile, Jakub Groszkowski, vice president of the Polish agency, voiced concerns about OpenAI's commitment to European personal data protection principles based on the complaint's claims. As part of the investigation, the agency will seek to quell these concerns, particularly in light of the GDPR's essential privacy by design principle. It's worth noting that this isn't OpenAI's first encounter with concerns over GDPR compliance in Europe. In March, Italian data protection authorities implemented temporary restrictions on the AI chatbot, ChatGPT, while it investigated possible violations of data privacy regulations. They also pointed out that OpenAI does not provide sufficient information to its users about data collection. By April, German regulators sought clarification regarding the company's intentions and capabilities to abide by the stringent data privacy laws under the GDPR. A unique working group was also organized by the European Data Protection Board to specifically focus on OpenAI.
