Google Sues Unknown Trio for Illicit Use of Trademarks in AI Chatbot Scam
Summary:
Google LLC has sued an unknown trio, referred to as "DOES 1-3", for creating deceptive advertisements for updates of Google's AI chatbot, Bard, which leads to the download of malware. The perpetrators allegedly used prominent Google trademarks to trick users into downloading the harmful software, targeting primarily businesses and advertisers. Google seeks damages, attorneys' fees, permanent injunctive relief, and more. This lawsuit comes amidst a significant rise in AI services usage worldwide.
Google LLC has initiated a legal dispute against a trio of unknown individuals for propagating false advertisements for updates to Google's AI chatbot, Bard, among other offerings. This fraudulent activity triggers the download of harmful software upon user interaction. The legal action, launched on November 13, refers to the fraudsters as "DOES 1-3", due to their anonymous status. Google alleges that these anonymous individuals capitalized on its AI products' well-known trademarks such as "Google, Google AI, and Bard" to entice innocent users into downloading malicious software.
Google provided an illustration of misleading social media content and pages that use its trademarks, deceptively appearing as a Google offering. These lures often include invites to download free versions of Bard and other AI tools. A court document showcased the imitative "Google AI" social media page utilized by the culprits.
The internet giant highlighted that oblivious users unintentionally download the harmful software through links designed to seize and misuse their social media credentials, primarily aimed at businesses and advertisers.
Google is petitioning the court for compensation and legal fees, a permanent injunction against the perpetrators for their harmful activities, forfeit of all profits amassed by the fraudsters, a comprehensive restraining order, and any other just action deemed appropriate by the court.
This development comes at a time of a significant uptick in the use of AI services, chatbots included, on a global scale. Recent data shows that Google's Bard bot attracts 49.7 million distinct visitors each month. OpenAI's ChatGPT, a widely-used AI chatbot service, records over 100 million monthly users and nearly 1.5 billion visits to its site each month.
The growing allure and availability of AI services has, unfortunately, also resulted in a spate of legal disputes involving the technology developers. OpenAI, Google, and Meta (owning company of Facebook and Instagram) all found themselves entangled in legal wrangles over the past year.
In July, Google was embroiled in a class-action suit where eight litigants, representing millions of internet users and copyright holders, accused Google of infringing their privacy and property rights. This took place following the update of Google's privacy policy that incorporated data harvesting features for AI learning.
