Bankman-Fried's defense strategy centred on his belief that his actions were lawful. However, Judge Lewis Kaplan accused him of perjury and described his evidence as elusive during his sentencing. His post-sentencing interview involved him stating, “I never imagined my actions were illegal.”
Evidence presented during the trial contradicted SBF's defense. A number of witnesses, including his ex-girlfriend and Alameda Research CEO, Caroline Ellison, hinted at his deliberated misuse of FTX customer funds.
Zhao, on the other hand, remained silent on the litigation against Binance following his guilty plea and a $4.3 billion resolution in November 2023. Numerous supportive letters from industry heads, family, and others were appreciated by Judge Richard Jones during Zhao's hearing, who noted CZ's substantial financial risk for Binance.
Terrence Yang, Swan Bitcoin Managing Director, briefed Cointelegraph that compared to SBF, CZ did not resist extradition and accepted lesser charges in his plea agreement, resulting in only a $50M payment in his deal with the DOJ.
Despite widespread speculation, it's highly improbable that CZ and SBF will share a prison cell or even be incarcerated in the same facility. While the judge presiding over SBF's case hinted at a San Francisco Bay Area prison, he could also have the ex-FTX CEO remain in New York during his appeal. Zhao's four-month sentence will be served at the Federal Detention Center SeaTac in Washington, with the reporting date yet to be confirmed.
