This disclosure emerged just ahead of a federal judge's hearing, planned to determine the case's continuation or dismissal, according to prior court documents. There has been no official explanation from the entrepreneur about his decision to end the lawsuit. Musk had initiated the lawsuit against OpenAI and Altman on the grounds of contract violation on February 29, 2024. Specifically, he accused the creators of ChatGPT of deviating from their initial vow to construct extensive language models for public advantage, not financial gain. He objected to the company's association with tech heavyweight Microsoft in the development of artificial general intelligence (AGI) technology and their launch of ChatGPT-4 under a non-open source model. Musk had proclaimed that OpenAI needed to abide by their open source commitment and asked for legal protection against AGI tech's commercial misuse. Along with these issues, Musk alleged violations of fiduciary responsibility and unfair business conduct against OpenAI. Musk's most recent critique of OpenAI concerns their collaboration with Apple to embed ChatGPT into Apple's device operating systems such as iPhone, iPad, and Mac. He alleges that this collaboration represents an "unacceptable security breach" against Apple users by placing their privacy and security in the hands of a third party—OpenAI. Despite this, Apple maintains that user IP addresses will remain private and OpenAI will not store any data requests. An Apple representative asserted, "It's conscious of your personal data without acquiring your personal data," emphasizing Apple Intelligence's dedication to privacy. In a further development, Musk launched Grok, an AI chatbot, in November with the intent of competing with ChatGPT. The company that developed Grok, xAI, attracted $6 billion in funding in late May from notable investors such as Valor Equity Partners, Andreessen Horowitz, Sequoia Capital, and Fidelity Management & Research Company.
